| I would offer to pay to put an inlet in the lowest spot of the ponding area. Then pay to run the drain to wherever you can get rid of the water, asking for an easement or maintenance agreement across his ground.
If you do that he may not have to fill in his side. You might even get him to chip in a little.
Even if you stand the whole cost, it is likely cheaper than fighting.
If you are getting government money, you may have to leave the drain at the old water level.
You might start out with outlining your project and how it would benefit him. No need to fill in the area etc. Then ask if he could chip in some.
If you have to stand the whole cost you are still ahead, especially if yours can be drained completely.
